SHOPS selling e-cigarettes across North Ayrshire are failing to comply with recent Government regulations.
The Council’s Trading Standards team carried out inspections of local retailers – and were disappointed that most retailers were failing to comply with legislation introduced earlier this year.
The Health (Tobacco, Nicotine etc. and Care) (Scotland) Act 2016, came in to force regulating the sale of e-cigs for the first time in April 2017.

After an initial education phase, enforcement, by Local Authorities, started on October 1, 2017.
During the inspections, liquids were found to be over the prescribed strength, and some shops were selling e-cigarettes that were nine months out of date.
Trading Standards are now urging anyone involved in selling e-cigs to check their stock to make sure they are in date , and not over the new maximum legal strength of no more than 20mg/ml(2%) of nicotine.
Each millilitre of e-liquid contains a dose of nicotine in milligrams. E-liquid nicotine suppliers represent this in a percentage – so 20mg is represented by 2%, 12mg as 1.2%, etc.
After seizing the offending products, Scott McKenzie, Senior Manager (Protective Services) said: “It is clearly disappointing that most retailers are still not following the legislation introduced earlier this year.
“There was always going to be an initial phase where shop owners were getting used to the new guidelines. But it is clear that more work now needs to be done. The legislation was introduced for a reason and to make the sale of e-cigarettes as safe as possible. That always has to be the priority and that’s why we will continue to work with retailers to try and get the message out there.
